Terms and conditions of business
1. Scope

The following Terms and Conditions (T&Cs) apply to all orders placed through our online shop by consumers and business customers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. A business customer is a natural or legal person or a legally recognized partnership that acts in the exercise of its trade, business, or profession when entering into a legal transaction.
For business customers: If the business customer uses conflicting or supplementary General Terms and Conditions, their validity is hereby expressly rejected unless we have explicitly agreed to them.

2. Contractual Partner, Conclusion of Contract, Correction Options

The purchase contract is concluded with PiliPili.
​
By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You may initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order using the correction tools provided and explained during the ordering process. The contract is concluded when you accept the offer for the items in your shopping cart by clicking the order button. You will receive a confirmation email immediately after submitting your order.

3. Contract Language, Storage of Contract Text

The language(s) available for the conclusion of the contract is/are: German.
We store the contract text in our systems, which are not accessible to you.

4. Delivery Conditions

4.1 Delivery Area
We deliver within Germany.
4.2 Shipping Costs
In addition to the stated product prices, a shipping cost of €4.39 is added for standard shipping.
4.3 Delivery Options
We ship the products to the delivery address specified during the order process.
Delivery is exclusively via shipping. Unfortunately, self-collection of the goods is not possible
5. Payment

The following payment methods are generally available in our shop:

PayPal
To pay the invoice amount via PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate yourself with your login details, and confirm the payment instruction. The payment transaction will be executed by PayPal immediately after placing the order. Further information is available during the order process.

PayPal may offer additional payment methods to registered customers based on its criteria. We do not influence these offers. For more details, please refer to your PayPal account.

6. Right of Withdrawal
​
You are entitled to the statutory right of withdrawal as described in the withdrawal policy.

7. Retention of Title
​
The product remains our property until full payment is received.
​
For business customers, the following applies additionally: We retain ownership of the product until all claims from the ongoing business relationship are fully settled. You may resell the goods in the ordinary course of business; any claims arising from such resale are assigned to us in advance up to the invoice amount, and we accept this assignment. You remain authorized to collect the claims, but we may also collect claims ourselves if you fail to meet your payment obligations. We will release securities upon your request, provided their realizable value exceeds the outstanding claims by more than 10%.

8. Transport Damage
For business customers: The risk of accidental loss or deterioration of the goods passes to you once we hand over the goods to the carrier, freight forwarder, or other party designated to execute the shipment.

9. Warranty and Guarantees

9.1 Liability for Defects
Unless expressly agreed otherwise below, the statutory liability for defects applies.
The following limitations and shortened terms do not apply to claims arising from damage caused by us, our legal representatives, or our vicarious agents:

In the event of injury to life, body, or health.

In the event of intentional or grossly negligent breach of duty or fraudulent intent.

In the event of a breach of essential contractual obligations, whose performance is necessary for the proper execution of the contract and on which the contractual partner regularly relies (cardinal obligations).

Under a guarantee promise, if agreed.

To the extent that the scope of the Product Liability Act is applicable.

Limitations for Business Customers
For business customers, only our statements and the manufacturer’s product descriptions included in the contract are deemed as agreements on the quality of the goods. We accept no liability for public statements made by the manufacturer or other advertising content.

The limitation period for defect claims for newly manufactured goods is one year from the transfer of risk. The preceding sentence does not apply to goods used for a building and causing its defectiveness.

The statutory limitation periods for recourse claims under § 445a BGB remain unaffected.
​
Notice for Merchants
Merchants are subject to the obligation to inspect and give notice of defects under § 377 HGB. Failure to comply results in the goods being deemed approved, except in the case of a defect not identifiable during inspection. This does not apply if we have fraudulently concealed a defect.

9.2 Guarantees and Customer Service
Details of any additional guarantees and their exact terms can be found with the product and on specific informational pages in the online shop.

We are fully liable for damages caused by us, our legal representatives, or vicarious agents:

In case of injury to life, body, or health.

In case of intentional or grossly negligent breach of duty.

To the extent that the scope of the Product Liability Act is applicable.

In the event of a breach of essential contractual obligations whose performance is necessary for the proper execution of the contract and on which the contractual partner regularly relies (cardinal obligations), liability is limited to foreseeable damages typical at the time of contract conclusion in cases of slight negligence.

Otherwise, claims for damages are excluded.

11. Dispute Resolution
​
The European Commission provides a platform for online dispute resolution (ODR), available here. We are willing to participate in an out-of-court dispute resolution procedure before a consumer arbitration board.

12. Final Provisions
​
If you are a business customer, German law applies to the exclusion of the UN Sales Convention.
